Lead Spark Terms of Service

Provider: Lead Burst Media LLC (“Lead Spark”, “we”, “us”)

1. Acceptance of Terms

By subscribing, using our services, or clicking your plan’s payment button, you agree to these Terms and our Privacy Policy. These form the binding agreement between you (“you”, “Client”) and Lead Spark.

2. Services & Pricing Plans

We offer tiered plans with specified setup fees, monthly subscriptions, included SMS segments, and per-segment overage fees:

A segment is 160 characters. Longer messages count as multiple segments.

3. Billing & 90-Day Minimum

You will pay the setup fee (if applicable) plus the first month’s subscription fee immediately upon checkout. There is a mandatory 90-day minimum contract. After 90 days, your plan moves to a month-to-month subscription, cancelable at any time with 30 days’ notice.

4. SMS Overage Charges

If your monthly SMS usage exceeds the included segments, overage fees will be billed in your next monthly invoice at your plan’s specified per-segment rate.

5. Payments & Invoices

All billing is in USD via Stripe. Setup and subscription fees are non-refundable. SMS overages are billed post-usage. You will receive monthly receipts. Refusing payments or reversing transactions may result in suspension or termination.

6. Cancellation & Refunds

No refunds on setup fees or prepaid service. You may only cancel after the initial 90-day minimum. To cancel, submit a request via email to billing@sparkmyleads.com or via support chat.

7. Client Responsibilities & Compliance

You agree to:

Provide lawful consent from SMS recipients and comply with relevant laws (e.g., TCPA, CAN-SPAM).
Provide accurate lead data and maintain responsible use.
Abide by our Acceptable Use Policy (no spam, malicious code, or illegal content).

8. Intellectual Property

You retain ownership over your data and content. Lead Spark retains all rights in its software and technology. You receive a limited, revocable license to use our platform.

9. Service Availability

While we strive for 24/7 availability, we cannot guarantee uninterrupted service. We are not liable for outages or third-party disruptions.

10. Disclaimers & Limitations of Liability

Services are provided “as is.” We don’t guarantee results. Maximum liability is limited to the last three months of your fees. We’re not liable for indirect damages or lost data.

11. Modifications to Terms

We may update these terms occasionally. Substantial changes will be communicated via email or platform notifications. Continued service implies acceptance of changes.

12. Governing Law

These Terms are governed by the laws of Wyoming. Any disputes will be resolved in Wyoming courts.

14. A2P 10DLC Compliance (SMS Delivery & Registration)

Registration Requirements: You may be required to complete a one-time business registration and campaign approval process (A2P 10DLC) to enable SMS sending. This includes providing your EIN, company address, website, and sample messages.
Approval Delays & Responsibility: Campaign approvals are handled by The Campaign Registry (TCR) and mobile carriers. We are not responsible for delays or rejections.
Fees: A2P registration and campaign fees are passed through and non-refundable.
Content Restrictions: You may not send prohibited content, including SHAFT (sex, hate, alcohol, firearms, tobacco), lead-gen without registration, or loan/credit messaging without opt-in.
Consent Compliance: You must only message users who have opted in and include opt-out language (e.g., “Reply STOP to unsubscribe”).
Violations & Liability: You are liable for fines, blocked traffic, or termination if your messaging causes violations or carrier penalties.
Lead Spark’s Role: We provide infrastructure; you are the sender of record and responsible for legal compliance.
